Provisions regarding the Privileged Entrepreneur apply to contracts concluded from 1 January 2021.

Appendix No. 1: Model withdrawal form

 

§ 1 DEFINITIONS

Business days – days from Monday to Friday, excluding public holidays.

Consumer – a consumer within the meaning of the Civil Code.

Account – a free-of-charge Store function (an electronic service) regulated by separate terms, allowing the Buyer to create an individual account in the Store.

Buyer – any entity making purchases in the Store.

Privileged Buyer – a Consumer or a Privileged Entrepreneur.

Privileged Entrepreneur – a natural person concluding an agreement with the Seller directly related to their business activity, but not of a professional nature (definition applies to contracts concluded from 1 January 2021).

Regulations – these Store regulations.

§ 2 CONTACT WITH THE SELLER

§ 3 TECHNICAL REQUIREMENTS

  1. For proper functioning of the Store, the following are required: a device with Internet access, a web browser supporting JavaScript and cookies.
  1. To place an order in the Store, in addition to the requirements set out in point 1, an active e-mail account is required.

§ 4 SHOPPING IN THE STORE

  1. Prices of goods displayed in the Store are total prices.
  2. The Seller indicates that the total order price consists of the product price and, if applicable, delivery costs.
  3. The selected product must be added to the shopping cart.
  4. The Buyer then selects the delivery method and payment method and provides data necessary to complete the order.
  5. The order is placed when its content is confirmed and the Regulations are accepted by the Buyer.
  6. Placing an order constitutes the conclusion of a sales contract between the Buyer and the Seller.
  7. The Seller shall provide the Privileged Buyer with confirmation of the sales contract on a durable medium no later than upon delivery.
  8. The Buyer may create an Account in the Store or make purchases without registration.

§ 5 PAYMENTS

  1. The Buyer may pay for the order using:
    • payment platform: Mollie – Przelewy24, Payment by bank, Credit card – Visa , Mastercard
  2. If advance payment is selected, payment must be made within 2 business days from placing the order.
  3. For certain payment methods, payment is only possible immediately after placing the order.

§ 6 ORDER FULFILLMENT

  1. The Seller is obliged to deliver the goods without undue delay.
  2. The order fulfillment time is up to 3 business days unless otherwise stated on the product page.
  3. If advance payment is selected, order fulfillment begins after payment is received.
  4. Delivery is free in EU.
  5. Delivery includes: Courier delivery – DHL, UPS, DPD.

§ 7 RIGHT OF WITHDRAWAL

  1. The Privileged Buyer has the right to withdraw from the contract within 14 days without giving any reason, subject to §8.
  2. The withdrawal period expires after 14 days from:
    1. the day the Buyer receives the goods;
    2. the day the last item is received in the case of multiple items;
    3. the conclusion of the contract – for digital content.
  3. To exercise the right of withdrawal, the Buyer must inform the Seller using the contact details in §2.
  4. The Buyer may use the withdrawal form template, but it is not mandatory.
  5. Sending the withdrawal notice before the deadline is sufficient.

EFFECTS OF WITHDRAWAL

  1. The Seller shall refund all payments, including delivery costs (except additional costs) in EU, within 14 days.
  2. Refunds will be made using the same payment method unless agreed otherwise.
  3. The Seller may withhold the refund until goods are returned or proof of return is provided.
  4. Returned goods should be sent to the Seller’s address within 14 days.
  5. The Buyer bears the direct cost of return.
  6. The Buyer is responsible for diminished value resulting from improper use.

§ 8 EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

  1. The right of withdrawal does not apply to contracts:
    1. for custom-made products;
    2. for perishable goods;
    3. for sealed goods unsealed after delivery for hygiene reasons;
    4. for goods inseparably combined with other items;
    5. for sealed audio/video recordings or software opened after delivery;
    6. for newspapers, magazines (except subscriptions).

§ 9 COMPLAINTS

  1. If goods are defective, the Buyer may submit a complaint under warranty or guarantee.
  2. Complaints should be submitted using contact details in §2.
  3. Complaints will be reviewed within 14 days.
  4. Complaints are handled in accordance with the provisions of the Polish Civil Code and applicable EU consumer protection laws.

§ 10 PERSONAL DATA

  1. The Seller is the data controller of personal data provided by Buyers.
  2. Personal data are processed to fulfill orders in accordance with GDPR.
  3. Providing data is voluntary but necessary to conclude a contract.

§ 11 FINAL PROVISIONS

  1. Providing unlawful content is prohibited.
  2. Each order constitutes a separate sales contract.
  3. In case of discrepancies, the Polish language version shall prevail.
  4. Disputes with non-privileged Buyers shall be resolved by the court competent for the Seller’s seat.
  5. These Regulations and contracts concluded under them are governed by Polish law.
